Clarification on grant of Non-functional Scale to Gr. 'B' officers in organized departments of Indian Railways

Sub.: Clarification on grant of Non-functional Scale to Gr. 'B' officers in Level-11 Level 10 of Accounts Department and Level-10 in organized departments of Indian Railways- reg.

n terms of Ministry of Railways' Gazette Notification G.S.R. 210(E) dated 08.03.2018 (RBE No. 37/2018), the higher scale of Level-11 Level 10 in Accounts department and Level-10 in other organised departments has to be operated to the extent of 100% of the Gr. 'B' officers on-roll including Gr. 'B' officers officiating in Level-11 Level 10 on ad-hoc basis after completion of 4 years of regular service in the respective grades in organized departments. Subsequently, detailed guidelines outlining the procedure have also been issued vide Board's letter no. E(GP) 2003/2/22) dated 12.12.2018 (RBE No. 192/2018).

2. It has been observed that references are being received from various Zonal Railways seeking clarification on issues relating to the aforementioned scheme. In the past, several clarifications have been issued to various Zonal Railways over a number of issues. Therefore, in order to provide clarity on the issue, these clarifications are being summarised as under:

Whether Gr. 'B' officers completing 4 years of regular service are to be granted NFS from the next date or from 1st January or 1st July of the following year.
The date of effect of placement in the higher Group 'B' non-functional grade will be the date when the officer becomes eligible i.e. when the officer completes four years of regular service in the relevant grade.

Clarification whether Gr 'B' officers on deputation, on the date of their consideration for grant of NFS to be taken to be on roll or total no. of Gr. 'B' officers be computed excluding their names.
Officers on deputation to other departments may be granted Non­ functional Scale of Level-10 notionally from 08.03.2018 while the actual benefit will accrue to them on return from deputation and joining the cadre.
3.
Grading of APAR for allotment of higher scale of Level-11 Level 10 to Gr. 'B' officers of Accounts Department and Level- 10 of other organised Departments.
The benchmark for grant of NFS of Level-11 Level 10 to Gr. 'B' officers of Accounts Department and Level-10 of other organised Departments would continue to be 'Good'.
4.
Whether Gr. 'B' officers 'On-roll' includes officers on deputation.
Yes. The term Gr. 'B' officers on-roll mentioned in Board's letter dated 08.03.2018 also include officers who are having their lien on the Railway but are working elsewhere on deputation.
5.
APARs
Five years APARs are required to be considered. If any APARs is not available, the APARs of the immediately preceding year/years to that extent may be taken into account even if it pertains to non-gazetted period of service.
6.
Whether a senior employee can be considered for grant of NFS with his junior having already completed 4 years of service.
For consideration of officers for placement in the higher Gr. 'B' Scale of Level-10 (Level-11 Level 10 in case of Accounts department), the senior Group 'B' employee shall be deemed to have rendered the service put in by his immediate junior and if that happens 4 years or more he should be considered for placement in higher Gr. 'B' scale of Level-10 (Level-11 Level 10 in case of Accounts department).
7.
Extended Panel is required to be formed in lieu of officers who would be retiring during the intervening period.
Since the posts are being operated at 100% and officers are being granted the benefit from the date on which they are becoming eligible (through assessment being done on the prescribed date), formation of extended panel is not required.
8.
Whether service rendered in the Gr. 'B' in the previous unit can be considered for grant of NFS.
The issue may be decided in terms of Board's Letter No. E(GP)2005/1/43 dated 16.12.2005.

Sub: Issue of Special Passes to Railway Servants who are Persons with Disability to participate in Conferences/ Workshops/ Seminars/ Trainings for skill development organized under the aegis of Staff Benefit Fund. 

Ref: (i) National Federation of Indian Railwaymen's (NFIR) letter No.II.28/ Pt.VI dated 26.01.2018. 
(ii) Board's letter No. E(W)2014/FU-1/1 dated 30.07.2014. 
(iii) Board's letter No. E(G)2015 LE 1-15 dated 15.06.2015. 


It has been brought to the notice of Board by NFIR that Railway Servants who are Persons with Disability (PwD) are presently required to avail their own Privilege Passes · for attending the Programmes/Camps conducted for them under the aegis of Staff Benefit Fund (SBF). The matter has been examined.

2. It has been observed that in terms of Board's letter cited under Ref.(ii) above, conduct of Conferences/Workshops/Seminars/Trainings for developing occupational skills of the PwD employees is admissible under SBF and, moreover, in terms of instructions contained in Department of Personnel & Training's OM No. 28016/02/2007- Estt (A) dated 20.03.2008, as circulated vide Board's letter cited under Ref.(iii), participation of PwD employees in the Conferences/Workshops/Seminars/Trainings for their development is to be facilitated. 
3. Keeping the above in view, it has been decided that PwD Railway Servants may be issued Special Passes to participate in Conferences/Workshops/Seminars/Trainings that are organized under the aegis of SBF for their development. The Class of the pass will be same as on privilege account. However, such facility will not be permissible for Camps.

Subject: Seeking data regarding fixation of pay at the time of regular promotion/ grant of NFSG in respect of officials who are already granted the benefit under MACP Scheme -regarding

The undersigned is directed to refer to this Department's OM No. 12/2/2015- CS.II(B) dated 16.11.2015 and OM No. 12/3/2016-CS.ll(B) dated 19.07.2016 wherein the SSAs of SL-2003(Extended) and SSAs of SL-2004-2009 were granted NFSG and promoted subsequently to the grade of Assistant Section Officer on ad-hoc basis. It has come to notice that a large number of Ministries I Departments have fixed the pay of the SSAs belonging to CSCS in the following manner:-

SSAs with the benefit of MACP (with Grade Pay of Rs.2800/-)
One increment @ 3% was granted and pay fixation in GP of Rs. 4200/-
No increment was granted. Only, the difference in GP(i.e. 4600-4200=40 0) was allowed.
2. The matter has been examined in consultation with Establishment Division, DoP&T in the light of the OM No. 35034/3/2008-Estt (D) dated 04.07. 2017 modifying the para 4 of Annexure-I of the OM dated 19.05.2009, which is as under:-
"Benefit of pay fixation available at the time of regular promotion shall also be allowed at the time of financial upgradation under the Scheme. Therefore, the pay shall be raised by 3% of the total pay in the pay band and the grade pay drawn before such upgradation. There shall, however, be no further fixation of pay at the time of regular promotion / grant of Non Functional Scale. ii it is in the same grade pay as granted under MACPS. However, at the time of actual promotion / grant of Non Functional Scale if it happens to be in a post carrying higher grade pay than what is available under MACPS, no pay fixation would be available and only difference of grade pay would be made available. At the time of such regular promotion / grant of Non-Functional Scale to the higher grade pay than what has been given under MACPS, the employee shall have the option to draw the difference of Grade Pays from the date of such regular promotion /grant of Non-Functional Scale or the date of accrual of next increment in the pay allowed under MACP"
As every financial upgradation including Non-Functional upgradation (NFS/NFSG) is treated as an offset against financial upgradation under MACP and also keeping in view the fact that the spirit of the para 4 of MACP was to disallow the double benefit of pay fixation, is stated that practice followed by Ministry/Department for pay fixal'1on as shown in the table against sl. no. (b) in para 1 above is erroneous. Therefore, the pay should be fixed in the following manner:-

4. In view of above, all the cadre units of CSCS are requested to take necessary action as advised in the para 3 above. Simultaneously, they are also requested to send the information as per the format given in the Annexure-I to this OM for further examination of the issue of recovery of pay for taking a view at this end. The information may be sent latest by 09.09.2019 positively. In case of no information, 'Nil' report is required to be sent by the stipulated date.
