OFFICE MEMORANDUM

Subject: Admissibility of air fare for children below the age of 5 years of the Government servants non-entitled to travel by air on LTC - clarification reg.
The undersigned is directed to invite reference to Department of Personnel Training’s O.M. No. 31011/2/2006-Estt.A dated 24.4.2006, 21.05.2007 and 03.12.2007 which stipulates that a non-entitled Goverment servant is allowed to travel by air while availing LTC provided that the reimbursement made in such cases is restricted to the train fare of entitled class. In this regard, it may be noted that while no fare is charged by Railways for a child below the age of 5 years travelling by train, airlines charge full air fare for child of 2 years of age and above.

2. This Department is in receipt of references from various Ministries/Departments seeking clarification on reimbursement of LTC claim in a situation where a child of a non-entitled Government servant, aged less than 5 years, travels by air on LTC and entitled train fare is claimed by that Government employee in respect of his/her child.

3. The matter has been examined and it is clarified that since children below the age of 5 years are not charged for rail journeys, no reimbursement shall be made in respect of the air journey performed by children, aged less than 5 years, of the Government servants who are not entitled to travel by air on LTC. It may be noted that this provision shall not be applicable for the segments where the air journey has been allowed to the non-entitled Government servants and their families under the special dispensation scheme, existent from time to time.

Counting of Induction training period for grant of financial up-gradation under MACP Scheme

MACP Scheme to Central Government Civil Employees w.e.f 01/09/2008 - Corrigendum dtd 23/06/2016

Counting of training period for those who are trained and recruited after 01.01.1986 for TBOP and BCR  was  already in force 11/1991. The extension of this factor to those who were trained and appointed before 01.01.1986 is the order now stands to envisage. The counting of trg period for TBOP BCR is a distinct matter and need not be taken for MACP.  This is what clarification at point 2 asserts.
But the MACP which is in replacement of TBOP BCR is effective from 1.9.08 as per MACP order dtd 18.5.2009.
In para 9 of this order, there was an erroneous coining of sentence that made the pre appointment  training ineligible for computing the qualifying service for MACP.
The pre appointment training was equated with ad-hoc and contract service by the conjunction 'or'. This was absolutely a typographical error because the basic ACP Scheme 1997  for other department and our own TBOP BCR allowed the reckoning of pre appointment training  for the financial  upgradation as the case may be 
This error was sought to be corrected by CHQ and the Amendment of removing the  'or'  with the conjunction 'on' has been issued in the 23.6.2016.
Both the amendment OM with page 6 having para 9 of the original OM is posted above.
Our argument should therefore be focused on this rulings and nit with BCR TBOP related rules. 
Except ad-hoc or contractual services before the regular appointment on pre appointment training all the period of training will be counted for MACP.
It is based upon this amendment the orders for MACPs are being issued in some circles

Subject: Implementation of CCS (RP) Rules, 2016 - Exercising of option for fixation of pay
This is regarding exercising of option for fixation of pay in the revised pay structure in terms of following provisions of CCS (RP) Rules, 2016:
Para 5
Save as otherwise provided in these rules, a Governments servant shall draw pay in the Level in the revised pay structure applicable to the post to which he is appointed.
Provisio 1
Provided that a Government servant may elect to continue to draw pay in the existing pay structure until the date on which he earns his next or any subsequent increments the existing pay structure or until he vacats his post or ceases to draw pay in the existing pay structure.
Provisio 2
Provided further that in cases where a Government servant has been placed in a higher grade pay or scale between 1st day of January, 2016 and the date of notification of these rules on account of promotion or upgradation, the Government servant may elect switch over to the revised pay structure from the date of such promotion or upgradation, as the case may be.
2.  Regarding the aforesaid provision, clarification was sought from Ministry of Finance/Dept. of Expenditure on the issue of exercising of option for fixation of pay by the government servants in 6th CPC Pay Structure till their promotion which falls after the date of notification of CCS (RP) Rules, 2016 (i.e. 25.07.2016).
3.  Now, MoF(DoE) have issued clarification dated 19.03.2018 (copy enclosed) wherein it has been clarified that the option for fixation of pay in the revised pay structure after the date of notification of CCS (RP) Rules, 2016 i.e. 25.07.2016 cannot be exercised as Rule 5 of the said Rules provided for option only for promotion taking place upto 25.07.2016 (date of notification of the said Rules)
4.  The clarification guidelines mentioned in para 3 above may please be adhered to.

Time Limits under Right to Information Act 2005



RTI Act Prescribes time limit under which the reply need to be given by Public Information Officer.
  • For PIO to reply to application: 30 days from date of receipt of application
  • For PIO to transfer to another PA under Sec 6(3): 5 days from date of receipt of application
  • For PIO to issue notice to 3rd Party: 5 days from date of receipt of application
  • For 3rd Party to make a representation to PIO: 10 days from receipt of notice from PIO
  • For PIO to reply to application if 3rdParty involved : 40 days from date of receipt of application
  • For applicant to make First Appeal: 30 days from date of receipt of PIO’s reply or from date when reply was to be received
  • For First Appellate Authority to pass an order: 30 days from receipt of First Appeal OR Maximum 45 days, if reasons for delay are given in writing
  • For applicant to make Second Appeal before CIC/SIC: 90 days from receipt of First Appeal orders or from the date when orders were to be received
  • For CIC/SIC to decide Second Appeal: No time limit specified

Concerning the posting at the same place of husband and wife who are working in Government service, the transfer issues have been raised in Parliament on several occasions. In 1980’s these demands began to show its seriousness, because the percentage of women employees were increased in joining the Government services. The Central Government also observed this issue from various forums, a circular had been issued by the Department of Social Welfare in Feb 1976 to all Head of Departments to give serious consideration to the requests of posting of husband and wife at the same station. In order to that order, lot of women employees started to send their request to transfer at the place where their husbands are posted.
The Central Government gave its utmost importance to this issue and as far as possible and within the constraints of administrative feasibility, the husband and wife should be posted at the same station to enable them to lead a normal family life and to ensure the education and welfare of their children. The Department of Personnel and Training issued an OM on 3.4.86, in accordance with the guidelines and instructions in the order given by the Government, all cadre controlling authorities should consider such requests with the utmost sympathy.
The Department of Personnel and Training issued various office memorandums regarding this matter from time to time. The motive of the Government on the petitioners, said in the orders repeatedly, to give utmost importance attached to the enhancement of women’s status in all walks of life and to enable them to lead a normal family life as also to ensure the education and welfare of the children.
Till recently, the persmin has issued total of six orders pertaining the above subject on its website. After implementation of the 6th CPC, the last order has been issued on 30.09.2009. The order said that “On the basis of the 6th CPC reprot, Government servants have already been allowed the facility of Child Care Leave which is admissible till the children attain 18 years of age”. The consolidated guidelines concerened this subject has been provided in the OM dated 12.06.1997. The consolidated guidelines has been amended and published in the last order after implementation of 6th CPC.
In the main guidelines, ”The husband & wife, if working in the same Department and if the required level of post is available, should invariably be posted together in order to enable them to lead a normal family life and look after the welfare of their children especially till the children attain 18 years of age. This will not apply on appointment under the central Staffing Scheme. Where only wife is a Govt. servant, the above concessions would be applicable to the Govt. servant. Complaints are sometimes received that even if posts are available in the station of posting of the spouse, the administrative authorities do not accommodate the employees citing administrative reasons. In all such cases, the cadre controlling authority should strive to post the employee at the station of the spouse and in case of inability to do so, specific reasons, therefor, may be communicated to the employee”.
