Cadre Restructuring of Stenographers

I am writing this in continuation of my previous letter regarding the meeting with the DDG (E) on our cadre restructure on 10.01.2014. Now Please find the attached files i.e., Letter dated 21.01.2014 received from the Directorate on Cadre Restructuring of Stenographers which is self-explanatory. It
may kindly be ensured at your Circle that the reply to this Directorate letter may be sent on or before 25.01.2014, but see the reply sent atleast on Monday, the 27th January. Before sending the replies to this Dte letter dt.21.1.14, it may also kindly be ensured that implementation of another Dte order dt.16.1.2014 also regarding the merger of Gr.I and Gr.II is done before arriving the figures. The figures after the merger of Gr.I & II may be compared with the figures sent by the Directorate and confirmed.

Regarding the Proposed Postal Strike declared by the Confederation of Central Govt. Employees and Workers (including NFPE, FNPO etc) for two days on 12.2.14 and 13.2.14 in c/w 15 points of Charter of demands, it is requested kindly to send your opinion on our stand on or before 05.02.2014.

Suggestions received from Shri K.S. Krishna Murthy, Vice President, AIPSA

The order is not clear.  The process would not be completed by this order.  Firstly, the present Grade I and Grade II should be merged and redesignated as Grade I.  Secondly, the present Grade III should be redesignated as Grade II.  Thirdly, after merger of Grades, vacancies in the new Grade I should be filled up from the newly redesignated Grade II.  With this, there is every chance for seniors in Grade III to get promoted to Grade I.  The present order is focussing only on Grade I and Grade II.   An administrative order is sufficient for this and for future promotion from Grade II to Grade I, DPC is must and for the DPC to recommend eligibility criterion must be made available in the form of new recruitment rules.
Apart from this, new recruitment rules issued by the DOPT should be circulated.  We do not know for what reason the Directorate is referring the matter to the Law Department and the DOPT.  Is it due to the coinage of the term ‘model recruitment rules’, which sounds that they are not original?  Anyways, in the absence of new recruitment rules, eligibility criterion is not clear for promotion to Grade I from Grade II.  Unless, Grade III is not redesignated as Grade II, there shall be a void between Grade III and Grade I.  Also, a present Grade III stenographer would not be eligible to get Rs.4800 on attaining MACP III or 3rd promotion.  This is a big blow to Grade III stenographers.
This is not a complete happy situation.  I request our GS and other active members involved in getting these orders issued to focus on this.
The VI CPC has merged the pay scales of Grade II and Grade I stenographers in the pre-revised scales of Rs.5000-150-8000 and Rs.5500-175-9000 and placed them in the higher pay scale of Rs.Rs.6500-200-10500.  This is not merely a case of merger, but upgradation which goes to say that it should be ensured that all those Grade II and Grade I stenographers who were below Rs.6500/- should be brought to the minimum of Rs.6500-200-10500 i.e. Rs.6500/-.  If it were done, the minimum of the pay would have been Rs.16290 (including Grade Pay) in the new pay scales (Rs.6500x1.86+Rs.4200=Rs.16290).  This has nothing to do with parity issue and no demand to hike the GP is also involved in this.  This is just a demand for implementation of a glaring recommendation of the VI CPC and accepted by the Govt. of India.  Moreover, it was clearly stated in Dte. letter No.4-7/(MACPS)/2008-PCC, dated 2.5.2012 (cited at 4 above) that “it is wrong to conclude merger of pre-revised scale of pay of Rs.5000-8000, Rs.5500-9000 and Rs.6500-10500.  The Department has also at no point of time issued orders of merger of the Stenographers in these three pre-revised scales of pay in the light para (ii) of Section I of Part B of CCS (RP) Rules, 2008 notified in Gazette of India vide GSR 622 (E), dated 29.8.2008."  As such, it is crystal clear that our case is not a case of merger, but a case of upgradation, which means that every Grade II and Grade I Stenographer as on 1.1.2006 should be brought to the minimum of Rs.16290/-.  During the implementation of V CPC also, the scale of Inspectors was also enhanced and all the Inspectors were brought to the minimum of Rs.5500/-.  It is not understood why it is not happening in the case of stenographers.  If it happens, at least 30% of stenographers will be benefited.  This could be done at the level of the Directorate itself.
Next with some rigorous pursuit with the Directorate and the DOPT one more achievement that we have to aim it is that as all the Grade II and Grade I stenographers are elevated to Rs.6500-200-10500 in the pre-revised scale as on 1.1.2006, they are entitled for Rs.4600 GP with effect from 1.1.2006. 
I request our GS to seriously look into this.

Merger order

A letter from General Secretary

Dear friends,
            As already informed to you that Directorate has called AIPSA for a meeting on Cadre Restructuring of Stenos, we had been to Directorate on 10.01.2014.  We had our Cadre Restructuring Meeting with the following officers at Directorate on 10.01.2014.
1.      DDG (Estt)
2.      ADG (Estt)
3.      ADG (PCC)
4.      Director (Estt) and
5.      Mr. Sudharsana Rao.
I.                    Discussion on Merger Issue: First of all,  DDG (Estt) madam enquired about the merger issue. We have informed that the merger order was not implemented in almost all the circles except few and some circles like Andhra Pradesh and Tamil Nadu have sought clarifications like :
1.      The position of Stenos who were promoted from Grade III to Grade II prior to receipt of Directorate orders and
2.      The stenos who are  awaiting promotions from Grade III to further
            DDG(Estt) informed that action is initiated for immediate implementation of the orders and they are also calling for the reports from Circles.  It was also informed that instructions will be reiterated for implementation of the order.
II.   Discussion on Cadre restructuring:    DDG (Estt) Madam has agreed openly in the Meeting that the stenos were put to lot of disparity and injustice.  She has also informed that the Cadre Review has to be carried out once in 5 years after every pay commission which is not being done and instructed her staff that the cadre review cannot be neglected.
            Some officers raised questions over the increase in the promotion posts to P.S. and Sr. P.S. We have argued such increase in promotion has been made in some other departments like Defense and Income Tax. DDG (E).   Madam asked to submit the copies of the orders of those Departments, if so. We have submitted the required copies of orders of cadre Restructuring done in some other Ministries like Ministry of Defense and Income Tax in support of our demand for increase in the promotion posts to P.S. and Sr.P.S.  DDG(Estt) informed that such orders  will definitely strengthen our genuine demands and promised that she will do the needful. In  nutshell, We had a fruitful meeting with DDG (Estt) on this. Hoping for the Best.
III. Meeting with DDG (P): We also had a meeting  with DDG(P) who  informed that recruitment rules have been sent to DOPT and they will be implemented shortly.
            Friends, in the meantime, Directorate has issued an order on our Merger issue of Gr.I & II to Gr.I and Gr.III to Gr.II to implement in all the Circles consequent on our visit to Delhi on 10.01.2014 but without answering to the clarifications sought for by the A.P. & T.N. Circles in this regard.
            After assumption of the New Team:
1.      Directorate asked to submit revised proposal on cadre restructure – We have submitted the revised proposal.
2.      Directorate asked us to have discussion on the revised proposal – Discussed as above and the work is in progress.
3.      We have reiterated the Directorate to implement the merger order at all Circles – Now a separate order has been issued to all Circles to implement the merger order immediately. 
We are hoping for the best in the coming days.  However, if they call for any meeting and if there are any developments, it will be informed.

Fixation of pay of senior PAs of CSSS-reg.

Subject: Fixation of Pay of senior PAs in the pre-revised scale of Rs.7450-11500 with the PAs of CSSS promoted between 1.1.2006 to 31.8.2008 - clarification regarding allowing arrears - regarding.

The undersigned is directed to say that references are still being received from Ministries/Departments regarding fixation of pay of senior PAs of CSSS and payment of arrears in the revised pay structure with the PAs of CSSS who were promoted between 1.1.2006 to 31.8.2008. PAs of CSSS promoted between 1.1.2006 to 31.8.2008 were allowed arrears from the date of their promotion as they had come over to the revised pay on the date of their promotion. Seniors to such promotee PAs of CSSS, however, were subsequently allowed stepping up of their pay with reference to these officials and they were not allowed arrears on the ground that the officials with reference to whom they got their pay stepped up were also not entitled to this.

2. The issue of fixation of pay with reference to the pre-revised pay scale of Rs. 7450-11500 and payment of arrears was taken up by Establishment Division of this Department with Department of Expenditure as this amounts to compelling the senior official, who was already serving as PA prior to 1.1.2006 and opted for fixation of his pay under revised pay rules from 1.1.2006 to opt for revised pay structure from the date of stepping up with the junior.

3. It is, therefore, clarified that the senior is entitled to arrears of pay from the date he opted to come over to the Revised Pay Scales till the date of stepping up of pay. These will be paid on the basis of pay actually fixed as on 1.1.2006.

Clarification on reckoning of period of "Dies-non" while granting ACP/MACP to officials.

Sub: – Clarification on reckoning of period of “Dies non” while granting ACP / MACP to officials.

The issue of counting the period of “Dies non” for the purpose of ACP / MACP was raised in JCM (DC). The issue was examined in consultation with DoPT. The Nodal Department has clarified the issue vide DOFF ID NO. 78961/13/CR dated 14.11.13 as below:-

“Regular service for the purpose of grant of financial upgradations under MACPS includes all period spent, on deputation/foreign service, study leave and all other kind of leave, duly sanctioned by the competent authority. In terms of Government of India decisions relating to ” Treatment of willful absence from duty given under Rule 25 (leave) of CCS (Leave) Wes, 1973, the period of absence not covered by grant of leave shall have to be treated as “dies non” for all purpose, viz increment, leave and pension. Though the.period of dies non does not constitute break in service, but only the day (s) treated as dies non are not counted as duty for any purpose. Dies non is only a concession for permitting the beneficiary thereof to have subsequent service in continuation of the period of service before the beneficiary proceeded on unauthorized. absence.

“Accordingly, it is clarified that dies non period will not be counted as regular service for the purpose of grant of financial upgradation under ACP/MACP Schemes”.

OA 709/13 - OA filed for parity - present status

Our parity case filed  before the Central Administrative Tribunal, Ernakulam  vide OA No.709/13 has come up for hearing and again DOPT asked more time.  It is almost four months elapsed  inordinate delay  in giving reply.

To avoid further delay  another MA moved by the Confederation and six others  vide No.180/2014 before the CAT  which was heard and given 2 weeks time to DOPT for reply.  On getting reply we will have to move further.  Our moto is absolute parity.

Merger of Group D Posts

Subject : Effective date of merger of erstwhile Group D posts, now designated as Multi-tasking Staff in Pay Band-I Grade Pay Rs.1800 and recruitment to the post after implementation of the recommendation of the 6th CPC.

In pursuance to the recommendations of the 6th Central Pay Commission, this Department has issued model recruitment rules for the post of Multi-tasking Staff (erstwhile Group D posts) vide OM No. AB-14017/6/2009-Estt(RR) dated 30.4.2010. This Department is receiving references for clarification in regard to the date of effect of merger of erstwhile Group D posts and re-designation as Multi-tasking Staff.

2. The issue has been examined taking into account this Department’s OM No. 20020/4/2010-Estt(D) dated 30.4.2013 with regard to fixation of seniority of officers holding the merged grade of Multi-tasking Staff. It has been decided that the merger and re-designation of erstwhile Group D staff as Multi-taking Staff shall be effective from 29.8.2008. Ministries / Departments may issue orders accordingly in respect of erstwhile Group D posts in their Ministries / Departments and expedite the amendment of the Recruitment Rules of erstwhile Group D posts as the model RRs of MTS.

3. Ministry of Home Affairs etc. are requested to bring the contents of this O.M. to the notice of all their Attached / Subordinate Offices. The autonomous/statutory bodies may adopt the same with the approval of the competent authority as per the rules/ statutes.
