Removal of ceiling of maximum balance to be retained in a Post Office savings account.

Subject:- Removal of ceiling of maximum balance to be retained in a post office savings account- amendment to Rule-4 of the Post Office Savings Account Rules 1981 regarding.

Sir/Madam,

The undersigned is directed to say that issue of removal of ceiling of Rs.1 lac in single savings account and Rs.2 Lac in Joint Savings Account fixed in the year 2000 was under consideration in the Min. of Finance (DEA). This issue was linked to the benefit of exemption in Income Tax on the interest earned in Post Office Savings Account under Section10(15) (i) of Income Tax Act, 1961 by the CBDT and Min. of Finance (DEA). After sustained efforts on the part of this Directorate, Min. of Finance (DEA) has now amended Rule-4 of the Post Office Savings Account Rules 1981 vide G.S.R.681(E) F.No.2/5/2006-NS-II dated 15.9.2011 (copy enclosed). Some major benefits of this amendment are given below:

(i) From 1.10.2011, there will be no limit for retaining balance in single as well as joint savings account.

(ii) A depositor or depositor(s) can deposit any amount into single as well as joint savings account.

(iii) Maturity value of any savings instrument can be credited into savings account of the depositor standing in the same post office irrespective of the balance in the account.

(i) Any cheque either issued by Postmaster or any other authority irrespective of any amount can be credited into post office savings account irrespective of the balance in the account.

(ii) From the Financial year 2011-12, Interest income of Rs.3500/- in the case of single account and Rs.7000/- in case of Joint account will be exempted from Income Tax. (Section 10(15) (i) of Income Tax Act, 1961 amended vide Notification No. 32/2010 {F.No. 173/13/2011-IT A.I}/S.O.1296(E) dated 03.06.2011)

(iii) It is the duty of the depositor(s) to show the interest income earned from Post Office Savings Account(s) beyond the limit prescribed above in the Income Tax return and pay due Income Tax.

1. It is requested that all field units may be directed to give wide publicity to these changes in the shape of Public Notice and printing of leaflets.

2. This issues with the approval of DDG(FS).

          The undersigned is directed to refer to the O.M. of even number dated the 18.06.2010 and to state that the Ministry of Finance (Department of Expenditure) have clarified that the term ‘Entitled class” mentioned in para 1(ii) of the above quoted O.M. refers to “Economy class” only. All LTC claims for travel by air may accordingly be restricted to LTC-80 Economy class air fare of Air India from the date of issue of this Office Memorandum.
          2. Past cases already settled will not be re-opened.

Set up of Branch Committee of Confederation of Subordinate Central Government Stenographers at Kolkata

            On 20.09.2011, a meeting was convened at Kolkata under the Chairmanship of Shri M. Harisuthan, General Secretary of the Confederation and opened a branch and an adhoc branch Committee has been formed.  Shri N.K. Nath, PS to PMG, Office of the CPMG, Kolkata as President, Shri A.K. Halder, AIR Kolkata as Secretary and Shri Arup Kumar Sarkar , AIR Kolkata as Treasurer.

           This movement is to bring all Stenographers working in different subordinate offices under one umbrella.  The members attended stressed the need to implement CSSS parity to subordinate Stenographers immediately without any further discrimination.

The Union Cabinet decided to release an additional instalment of Dearness Allowance (DA) to Central Government employees and Dearness Relief (DR) to pensioners with effect from 01.07.2011. The DA shall be enhanced from the existing 51% to 58% representing an increase of 7%.

Grant of family pension to dependent parents of a deceased Government employee

OFFICE MEMORANDUM

                Subject: Grant of family pension to dependent parents of a deceased Government employee.

              The undersigned is directed to refer to this Department’s O.M.No. 45/86/97-P&PW(A)-part 1, dated 27.10.1997, whereby the definition of family for the purpose of grant of family pension was extended to include, inter ilia, “parents who were wholly dependent on the Government servant when he/ she was alive provided the deceased employee had left behind neither a widow nor a child”.”

2. It has been observed that Ministries/Departments have been interpreting this to mean that parents are eligible for family pension when the deceased employee is survived by them only. In case the deceased employee is survived by a widow and/ or one or more children, the parents are not considered eligible to receive family pension subsequent to such widow and / or children becoming ineligible to receive family pension or ceasing to survive.

3. It is hereby clarified that in case the deceased government servant is not survived by a widow/widower or a child, the dependent parents become directly eligible to receive family pension. In cases where a deceased Government servant is survived by a widow/widower or a child, and the position changes subsequently because of death or re-marriage of the spouse and/or death or ineligibility of child/children, including a disabled child, the dependent parents become eligible for family pension. However,in terms of this Department’s O.M. No. 38/37/08-P&PW(A) dated 02.09.08, a childless widow, subject to dependency criteria, is entitled to the family pension even alter her re-marriage. In such an event, the parents of the deceased employee become entitled to the family pension only after the childless widow dies or when her independent income from all other sources becomes equal to or higher than that prescribed for dependency criterion under the Rules.

4. This issues with the concurrence of Ministry of Finance, Department of Expenditure vide. U.O. No.248/E.V/2011, dated 2nd September, 2009.

Additional dearness allowance w.e.f. 01.07.2011

Cabinet Committee to decide on additional dearness allowance hike tomorrow, 8th September 2011
           
                  The Union Cabinet Committee  tomorrow may decide on raising additional dearness allowance to Central Government employees, official sources said. The Union Cabinet Committee likely to approve the additional installment of 7% dearness allowance to Central Government employees and dearness relief to Central Government pensioners due from 1.7.2011.  More than 50 lakh serving employees and 38 lakh pensioners are expecting eagerly for this announcement to compensate the price hike in essential commodities and other goods.

Stepping up of pay of Assistants/Steno Gr.C of CSS/CSSS


An important letter

If there is any error in the order dated 29-8-2011 the applicant can file a MA(Review Application) before the Hon'ble CAT, New Delhi by 29-9-2011 as per CAT Procedure. The impugned order dated 24-3-2009 should either be set aside or quashed or OA be dismissed if the applicant prays before the Hon'ble CAT to set aside impugned order dated 24-3-2009. However as the applicant's advocate pressed to withdraw the OA with liberty to file afresh so as to reconsider impugned order dated 24-3-2009 and also the Hon'ble CAT agreed the same the case was dismissed. As such, in my opinion, impugned order dated 24-3-2009 needs further elaboration and should not be contradictory with Ministry of Finance, OM dated 13-11-2009 wherein pay scale of 6500-10500 were upgraded to 7450-12000 w.e.f. 1-1-2006. As the Department felt not possible to layer 5000-8000, 5500-9000 and 6500-10500 again as per recommendation of 6CPC wherever 6500-10500 goes to 7450-12000 the scales of 5000-8000, 5500-9000 and 6500-10500 should follow. Hence Steno II, I and PS of outside Secretariat should be entitled 7450-12000 w.e.f. 1.1.2006 in terms of MOF OM dated 13-11-2009 and DOP impugned order dated 24-3-2009. In such assumption Steno-II and I of my office fixed pay at grade pay of Rs. 4600 w.e.f. 1.1.2006 and arrears drawn but till date no recovery is made.

CAT clarification

I showed the Judgement to Sr. PPS, CAT Patna Bench and sought his interpretation. He told me that :

(i) First AIPSA has to submit representation before the Respondent No. 1 and 2 i.e. Secretary (Department of Post,) and Secretary (Department of Expenditure, Ministry of Finance) and wait for their reply.
(ii) If AIPSA is not satisfied with the reply of respondents, only then they can approach CAT.
(iii) If the reply is not received upto six months from the respondents, only then AIPSA can approach CAT

Online-applications :- Only online applications shall be entertained for advance reservation for holiday homes where online facility has been commenced. Offline requests for advance reservation in such holiday homes will be summarily rejected. Application will be considered for confirmation only after receipt of hard copy with requisite Demand draft, complete in all respects. Incomplete/unverified applications will not be entertained. Confirmation will be subject to availability. Applications received after 10 days (including holidays) from the date of registration are liable to lose priority, assigned by Booking Request ID. Applications although registered but not received with DD within 20 days from the date of registration will be removed from the list of applicants. The application has not been made in the prescribed form, and forwarded through the Admn. Division.
Demand Draft covering full amount of room charges has not been enclosed.
Enclosed Demand Draft does not contain full amount of room charges.
The payee’s name has not been mentioned correctly in the Demand Draft.
Administrative Division of the applicant has not forwarded the application.
Accommodation is not available during the requested period.
The accommodation cannot be booked for more than 5 day in season period. (Mussurie – 3 days)
The applicant is not entitled to VIP accommodation.
The application has not been signed.
Only one room is booked in favour of a Government employee and/or his/her family.
There are no AC rooms / 4-bed room/ dormitory rooms in this Holiday Home/ Touring hostel, as requested.
No guest accomm. at the disposal of this office, in the city for which booking has been sought.
The application has been recd very late. The period of booking has already lapsed.
Copy of PPO has not been enclosed.
A certified copy of the Tour program containing the period of tour and the city, not enclosed.
This office is not the Allotting Authority for the requested accommodation.

Payment of interest on delayed payment of Gratuity.

Subject: Regarding payment of interest on delayed payment of gratuity.

           A number of proposals are being received from various departments seeking approval for payment of interest on delayed payment of gratuity in respect of retired government servants on account of administrative lapses.
          The attention of all the Departments is invited to the provisions laid down in RuIe-68 of CCS (Pension) Rules, 1972 and Government of India’s decisions thereunder. It has been provided that, if the payment of gratuity has been authorized later than the date when its payment becomes due, and it is clearly established that the delay in payment was attributable to administrative lapses, interest shall be paid at such rate as may be prescribed, and in accordance with instructions issued from time to time. In all cases where the payment of interest has been sanctioned by the department with the approval of the competent authority, such department shall fix responsibility and take disciplinary action against the government servant or servants responsible for the delay.
         All necessary steps should, therefore, be taken by the Head of Office for ensuring that payment of interest on delayed payment of gratuity is avoided. Officials dealing with such files should be held accountable and responsibility be fixed for not taking timely action in this regard.
        However, where disciplinary or judicial proceedings against a government servant are pending on the date of his retirement, no gratuity is to be paid until conclusion of the proceedings and issue of final orders thereon.
        Henceforth, it has been decided that in all cases of payment of interest on delayed payment of gratuity attributable to administrative delays [barring cases where disciplinary or judicial proceedings against a government servant are pending on the date of his retirement] action will be taken against officials responsible for such delays which may include recovery of the amount of Interest paid on account of delayed payment of gratuity from the salary of delinquent officers/officials.

                                  Subject: Physical vacancies of Stenographers Grade ‘D’ as on 1.9.2011.

The undersigned is directed to say that consequent upon the cadre review of CSSS, the sanctioned strength of Steno Grade ‘D’ has been fixed at 1282 and accordingly the sanctioned strength of all the Cadre Units in this grade has been revised vide this Department’s O.M. No.20/51/2009-CS.II(A) (Vol.11) dated 25.2.2011 while keeping the total strength of CSSS personnel intact.

2. In order to fill up the large number of vacancies percolating in Steno Grade ‘D’ after the cadre review of CSSS, 550 vacancies of Steno Grade ‘D’ for the SL year 2010 were intimated to SSC. The result of Steno Grade ‘C’ & ‘D’ Examination, 2010 has been declared by the SSC and 398 candidates have been recommended by the SSC for appointment as Steno Grade ‘D’ in the CSSS. Since the vacancies of Steno Grade ‘D’ in all the Cadre Units of CSSS are more than the number of candidates available for allocation, all the Cadre Units of CSSS are requested to intimate the physical vacancies of Steno Grade ‘D’ in the Annexure to this O.M. by 9.9.2011 so that proportionate allocation may be made. A brief note about CAT case


CAT CASE BRIEF

            I, along with Mr. K.S. Krishna Murthy, Treasurer, attended the hearing at CAT., New Delhi on 29.08.2011.  The Hon’ble CAT directed to represent on Annexure “A-1” to OA ie., letter No. 4-7/2008-PCC dtd. 24.03.2009 wherein it was mentioned that

“The common category of Stenographers in the field offices of Department of Posts have to be granted the revised pay structure for office staff working in organizations outside the Secretariat as notified by the CCS (RP) Rule, 2008 and the pay scale of common category posts can not be upgraded only in the case of a particular department.  Further, allowing upgradation of pay scales solely on account of (a) feeder grade post coming to lie in the same grade as the promotional posts; and (b) posts in the same pre-revised grade getting higher revised pay on account of the recommendations of the Sixth CPC will defeat the very purpose of de-layering for which the Pay Commission had recommended merger of pre-revised pay scales of Rs. 5,000-800, Rs. 5500-9000 and Rs. 6500-10500”.

As such, the case has been withdrawn for the time being.  THE CASE IS NOT DISMISSED.  IT IS STILL OPEN.  Please don’t get disheartened.  We will appeal again.

The said impugned order was actually a reply to our earlier representation dated 18.11.2008.  Hence, it was not felt necessary to appeal again and, in fact, we approached the CAT on the basis of the impugned order.  Next week, we will be filing again.  We will keep you informed
