APPLICATION UNDER SECTION 19 OF THE ADMINISTRATIVE TRIBUNALS ACT, 1985.
PARTICULARS OF THE ORDER AGAINST WHICH THE APPLICATION IS MADE:
(i) The present OA is being filed by Stenographers Gr.I, Gr II, Personal Secretary and Sr. Personal Secretary seeking parity of pay scale which has recommended and implemented by the recommendations of 6th CPC to the counter parts of the applicants performing identical duties and functions and situated at par in all functional requirements in Central Secretariat Stenographers Services (CSSS).
(ii) Order dated 24.03.2009 passed by Department of Posts, Ministry of Communications & IT in consultation with Ministry of Finance, Department of Expenditure whereby the demand of the applicants for grant of revised pay structure at par with CSSS has been turned down vide ANNEXURE A-1.
(iii) Order No.I/9/2009-PIC dated 1.6.2009 issued by Department of Personnel & Training whereby the issue of pay parity between CSSS and the non-secretariat Stenographers and also implementation of para 3.1.10 to 3.1.4 has not been acceded to vide ANNEXURE A-2.
(iv) Order dated 5.8.2010 issued by the respondents whereby the it has been informed to the Minister of State that the recommendations of 6th CPC contained in para 3.1.4 has been implemented by the Respondents in CCS (RP) Rules, 2008 vide ANNEXURE A-3.
8. RELIEF:
In view of the submissions made in the foregoing paras this Hon’ble Tribunal may be pleased:
8.1 To set aside the impugned order at Annexure A-1 to A-3.
8.2 To direct the respondents to declare Grade II Stenographers in postal department at par with their counterparts with CSSS for grant of GP 4600 w.e.f. 1.1.2006 with all consequential benefits.
8.3 To direct the respondents to declare PS in postal department at par with their counterparts with CSSS for grant of GP 4800 w.e.f. 1.1.2006 and GP 5400 after four years in PB-3 with all consequential benefits.
8.4 To direct the respondents to induct the posts of PPS, Sr. PPS and PSO in the Postal department and consider PS of Postal Department as PPS in GP of 6600, Sr. PPS in GP of 7600 and also further promotion in PSO with GP 8700 with all consequential benefits;
8.5 Any other relief which this Hon’ble Tribunal may deem fit and appropriate, in the circumstances of the case.
