Dharna Notice for 19.9.2017 and 17.10.2017 – Instructions under CCS (Conduct Rules), 1964 – DoPT

Subject:-Dharna Notice for 19th September, 2017 and 17th October, 2017 – Instructions under CCS (Conduct Rules), 1964 – Regarding.
It has been brought to the notice of the Government that Confederation of Central Government Employee and Workers has decided to observe dharna at district headquarters across the country on 19th September, 2017 followed by similar protest at all State capitals on 17th October, 2017. The proposed protests are in support of pay and service related demands.
2. The instructions issued by the Department of Personnel and Training prohibit the Government servants from participating in any form of strike including mass casual leave, go slow, sit-down etc. or any action that abet any form of strike in violation of Rule 7 of the CCS [conduct] Rules. 1964. Besides, in accordance with the proviso to Rule 17(1) of the Fundamental Rules, pay and allowances is not admissible to an employee for his absence from duty without any authority. As to the concomitant rights of an Association after it is formed, they cannot be different from the rights which can be claimed by the individual members of which the Association is composed. It follows that the right to form an Association does not include any guaranteed right to strike. There is no statutory provision empowering the employees to go on strike. The Supreme Court has also ruled in several judgements that going on a strike is a grave misconduct under the Conduct Rules and that misconduct by the Government employees is required to be dealt with in accordance with the law. Any employee going on strike in any form including dharna would face the consequences which besides deduction of wages may also include appropriate disciplinary action. Attention of all employees of this Department is also drawn to this Department’s O.M. No. 33012/I/(s)/2008 –Estt.(B) dated 12.9.2008 on the subject for strict compliance.
3. All officers are requested that the above instructions may be brought to the notice of the employees working under their control. All officers are also requested not to sanction Casual Leave or other kind of leave to the officers and employees if applied for during the period of proposed dharna and ensure that the willing employees are allowed hindrance free entry into the office premises.
4. In case employees go on dharna all divisional heads are requested to forward a report indicating the number and details of employees who are absent from duty on the day of strike i.e. 19.09.2017 and 17.10.2017.

Subject: Travel entitlements of Government employees for the purpose of LTC post Seventh Central Pay Commission-clarification reg.
The undersigned is directed to refer to this Department’s O.M. No. 31011/4/2008-Estt.A-IV dated 23.09.2008, which inter-alia provides that travel entitlements for the purpose of official tour/transfer or LTC, will be the same but no daily allowance shall be admissible for travel on LTC. Further, the facility shall be admissible only in respect of journeys performed in vehicles operated by the Government or any Corporation in the public sector run by the Central or State Government or a local body.
2. Consequent upon the decisions taken by Government on the recommendations of Seventh CPC relating to Travelling Allowance entitlements of Central Government employees, TA Rules have undergone changes vide Ministry of Finance’s O.M. No. 19030/1/2017-E.IV dated 13.07.2017.
3. In this regard, it is clarified that the travel entitlements of Government servants for the purpose of LTC shall be the same as TA entitlements as notified vide Ministry of Finance’s O.M. dated 13.07.2017, except the air travel entitlement for Level 6 to Level 8 of the Pay Matrix, which is allowed in respect of TA only and not for LTC.
4. Further, the following conditions may also be noted:
i. No daily allowance shall be admissible for travel on LTC.
ii. Any incidental expenses and the expenditure incurred on local journeys shall not be admissible.
iii. Reimbursement for the purpose of LTC shall be admissible in respect of journeys performed in vehicles operated by the Government or any Corporation in the public sector run by the Central or State Government or a local body.
iv. In case of journey between the places not connected by any public/Government means of transport, the Government servant shall be allowed reimbursement as per his entitlement for journey on transfer for a maximum limit of 100 Kms covered by the private/personal transport based on a self-certification from the
Government servant. Beyond this, the expenditure shall be borne by the Government servant.
v. Travel by Premium trains/Premium Tatkal trains/Suvidha trains is now allowed on LTC. Further, reimbursement of tatkal charges or premium tatkal charges shall also be admissible for the purpose of LTC.
vi. Flexi fare (dynamic fare) applicable in Rajdhani/Shatabdi/Duronto trains shall be admissible for the journey(s) performed by these trains on LTC. This dynamic fare component shall not be admissible in cases where a non-entitled Government servant travels by air and claims reimbursement for the entitled class of Rajdhani/Shatabdi/Duronto trains.

5. This O.M. will take effect from July 1, 2017.

Whether the employees in the following categories are eligible for the benefit of ad-hoc bonus for an accounting year
Subject to completion of minimum six 1 months continuous service and being in service as on 31st March, 2017..
(a)
Employees appointed on purely temporary ad-hoc basis.
(a)
Yes, if there is no break in service.

(b)
Employees who resigned, retired From service or expired before 31st March, 2017.
(b)
As a special case only those persons who superannuated or retired on invalidation on medical grounds or died before 31st March, 2017 but after completing at least six months regular service during the year will be eligible for the ad-hoc bonus on pro rata basis in terms of nearest number of months of service.

(c)
Employees on deputation/foreign service terms to state governments, U.T.Governments, Public Sector Undertakings, etc., on 31st March, 2017.
(c)
Such employees are not eligible for the ad-hoc bonus to be paid by the lending departments. In such cases the liability to pay ad-hoc bonus lies with the borrowing organization depending upon the ad-hoc bonus/PLB/ex-gratia/incentive payment scheme, if any, in force in the borrowing organization.

(d)
Employees who reverted during accounting year from deputation on foreign service with the organizations indicated in 'C' above.
(d)
The total amount of bonus/ex-gratia received for the accounting year from foreign employer and the ad-hoc bonus, if any, due from a central government office for the period after reversion will be restricted to the amount due under ad-hoc bonus as per these orders.

(e)
Employees from state Government/U.T. Admn./Public Sector Undertakings on reverse deputation with the Central Government.
(e)
Yes, they are eligible for ad-hoc bonus to be paid by the borrowing departments in terms of these orders provided no additional incentive as part of terms of deputation, other than Deputation Allowance, is paid and the lending authorities have no objection.

(f)
Superannuated employees who were re-employed.
(f)
Re-employment being fresh Employment eligibility period is to be worked out separately for re-employment period; the total amount admissible, if any, for prior to superannuation and that for re-employment period being restricted to the maximum admissible under ad-hoc bonus under these orders.


(g)
Employees on half-Pay leave/E.O.L./Leave not due/study leave at any time during the accounting year.
(g)
Except in the case of leave without pay the period of leave of other kinds will be included for the purpose of working out eligibility period. The period of E.O.L./dies non will be excluded from eligibility period but will not count as break in service for the purpose of ad-hoc bonus.

(h)
Contract employees.
(h)
Yes, if the employees are eligible for benefits like dearness allowance and interim relief. Categories not eligible for these benefits would be considered at par with casual labour in terms of ad-hoc bonus orders.

(i)
Employees under suspension at any time during the accounting year.
(i)
Subsistence allowance given to an employee under suspension for a period in the accounting year cannot be treated as emoluments. Such an employee becomes eligible for the benefit of ad-hoc bonus if and when reinstated with benefit of emoluments for the period of suspension, and in other cases such period will be excluded for the purpose of eligibility as in the case of employees on leave without pay.

(j)
Employees transferred from one Ministry./Department/Office covered by the Government of India or a Union Territory Government covered by ad-hoc bonus orders and vice versa.
(j)
Employees who are transferred from any of the ad-hoc bonus orders to another within Ministry/Department/Office covered by ad-hoc bonus orders to another such office without break in service will be eligible on the basis of combined period of service in the different organizations. Those who are nominated on the basis of a limited departmental or open competitive exam from one organization to a different organization will also be eligible for the ad-hoc bonus. The payment will be made only by the organization where he was employed as on 31st March 17 and no adjustments with the previous employer will be necessary.

(k)
Employees who are transferred from a Government Department/Organization covered by ad-hoc bonus orders to a Government Department/Organisation covered by productivity - Linked Bonus scheme or vice versa.
(k)
They may be paid what would have been paid on the basis of emoluments in ad-hoc bonus covered department for the entire year less the amount due as productivity-linked bonus. The amount so calculated may be paid by Department where he was working on 31st March, 2017 and/or at the time of payment.

(l)
Part-time employees engaged on nominal fixed payment
(I)
Not eligible.

Whether ad-hoc bonus is payable to casual labour for an accounting year in the following cases:-


(a)
Those who have put in specified number of days of work in different offices during each of the three years ending with the said accounting year.
(a)
The eligibility is to be worked out for three years from the said accounting year backwards. The period of 240 days of work in each of these years may be arrived at by combining the number of days worked in more than one offices of the government of India, for which bonus. ex-gratia or incentive payment has not been earned and received.


(b)
Casual labour who were not in work on 31st March, 2017.
(b)
The condition of being in employment on 31st March, 2017 as laid down in these orders is applicable to regular Government Employees and not to casual labour.

(c)
Those who have put in at least specified number of days of work in each of two years preceding the accounting year but are short of this limit due to regularization in employment in the said accounting year.
(c)
If a casual labour, who has been regularized in the accounting year does not fulfill the minimum continuous service of six months as on 31st March, 2017 and therefore, cannot be granted benefit as a regular employee, he may be allowed the benefit as for a casual labour provided the period of regular service in the said year if added to the period of work as casual labour works out to at least specified number of days in that accounting year.

78 Days Productivity Linked Bonus for Year 2016-17 - Railway Board Order RBE No. 134/2017

Subject : Payment of Productivity Linked Bonus to all eligible non-gazetted Railway employees for the financial year 2016-2017.
The President is pleased to sanction Productivity Linked Bonus (PLB) equivalent to 78 (Seventy Eight) days wages without any ceiling on wages for eligibility for the financial year 2016-17 to all eligible non-gazetted Railway employees (excluding all RPF/RPSF personnel). Where, wages exceed ₹ 7000/- per month, Productivity Linked Bonus will be calculated as if the ‘wages’ are ₹ 7000/- pm.

2. ‘Wages’ for the purpose of calculating Productivity Linked Bonus shall include ‘Basic pay’ as defined in the Railway Services (Revised Pay) Rules, 2016 and dearness allowance drawn during the financial year 2016-17. Other conditions of eligibility, method of calculation of wages, etc., as prescribed in this Ministry’s instructions and clarifications issued from time to time, shall remain unchanged.

3. It has also been decided that in the case of eligible employees mentioned in Para 1 above who were not placed under suspension, or had not quit service/retired/expired during the financial year 2016-17 or were on leave where leave salary admissible is not less than that admissible on leave on average pay, may be paid an amount of ₹ 17,951/- towards Productivity Linked Bonus for the financial year 2016-17. In the case of employees other than those mentioned above. the amount of Productivity Linked Bonus may be calculated in accordance with the extant instructions on the subject.
4. Further, in relaxation to the provisions in Rules 905(2), 908 and 909 of State Railway Provident Fund Rules, as contained in Chapter 9 of R-I/1985 edition (2003 Reprint edition), such of the subscribers to the SRPF as are entitled to Productivity Linked Bonus may, if they so desire, deposit the whole or part of the amount admissible under the Scheme in their respective State Railway Provident Fund Accounts.
5. Disbursement of Productivity Linked Bonus for the financial year 2016-17 to all eligible non-gazetted Railway employees mentioned in Para 1 above should be made on priority in the same mode as payment of salary before the ensuing Puja/Dussehra holidays.
6. This issues with the concurrence ofFinance Directorate of the Ministry of Railways.

Subject: Grant of Dearness Allowance to Central Government employees Revised Rates effective from 01.07.2017.

The undersigned is directed to refer to this Ministrys Office Memorandum No. 1/312017-E.II(B) dated 30th March, 2017 on the subject mentioned above and to say that the President is pleased to decide that the Dearness Allowance to Central Government employees shall be enhanced from the existing rate of 4% to 5% of the basic pay per month, with effect from 1st July, 2017.

2. The term basic pay in the revised pay structure means the pay drawn in the prescribed Level in the Pay Matrix as per 7th CPC recommendations accepted by the Government. but does not, include any other type of pay like special pay, etc. 

3. The Dearness Allowance will continue to be a distinct element of remuneration and will not be treated as pay within the ambit of FR 9(21).

4. The payment on account of Dearness Allowance involving fractions of 50 paise and above may be rounded to the next higher rupee and the fractions of less than 50 paise may be ignored.

5. These orders shall also apply to the civilian employees paid from the Defence Services Estimates and the expenditure will be chargeable to “the relevant Head of the Defence. Services Estimates. In respect of Armed” Forces personnel and Railway employees, separate orders will be issued by-the Ministry of Defence and Ministry of Railways, respectively”.

6. In so far as the employees-working in the Indian Audit and Accounts Department are concerned, these orders are issued in consultation with the Comptroller and Auditor General of India.

2.Method of filling up of the vacancies :-
                  As per the Department of Posts (Postman and Mail Guard) Recruitment Rules, 2010, Column (11) (a) & (b)  and 12 (i) & (ii) circulated vide CO letter No.RE/30-13/1975(Rlg)/Corr dated 02.02.2011 & Department of Posts(Postman & Mail Guard) Recruitment(Amendment) Rule 2012 circulated vide CO letter No.RE/30-13/75(Rlg)/ corr. dated 19.07.2012
3.Eligibility  condition to apply for the Examination  :-
    For Postman:
       (i)Multi Tasking Staff (MTS) of the recruiting Division with three years regular service in the grade including service put in, if any against an erstwhile Group-D post on regular basis as on 1.4.2017 with satisfactory record of service are eligible to appear in the Departmental Examination for promotion to Postman  cadre (against 50% of vacancies).
(ii) Gramin Dak Sevaks of the recruiting Division who have worked for at least five years in that capacity as on 01.04.2017 are eligible to appear in the Departmental Examination for promotion to the cadre of Postman (against 50% of vacancies).
For Mail Guard:
(i) Multi Tasking Staff (MTS) of the recruiting Division with three years regular service in the grade including service put in, if any, against an erstwhile Group-D post on regular basis as on 1.4.2017 with satisfactory record of service are eligible to appear in the Departmental Examination for promotion to Postman/ Mail Guard  cadre (against 25% of vacancies).
(ii) Gramin Dak Sevaks of the recruiting Division who have worked for at least five years in that capacity as on 01.04.2017 are eligible to appear in the Departmental Examination for promotion to the cadre of Postman/ Mail Guard (against 25% of vacancies).
The age limit of Gramin Dak Sevaks  for appearing in the LDCE for promotion to the cadre of Postman / Mail Guard shall be 50 years as on 01.04.2017 (Relaxable  for those belonging to Schedules Caste/ Scheduled Tribe upto five years and for those belonging to  Other Backward Castes upto three years).
4.Educational Qualification:
No educational qualification is prescribed for direct recruitment on the basis of Limited Departmental Competitive Examination.
5. Vacancies
The vacancy position for the years 2017-18 for Postman and Mail Guard is at Annexure-IV. The vacancy position may also vary/change depending on mistakes being detected and reported by the units subsequently. 
6.    General Conditions:
(i)    The Departmental Examination shall be common for both MTS and GDS.
(ii)   Reservation benefit as applicable to SC/ST/OBC/PH will be provided in case of recruitment of GDS to the cadre of Postman/ Mail Guard etc.
(iii)  The Departmental Examination may also be conducted for the Divisions where no vacancies are declared. The cases of candidates of such Divisions will be considered as per rules.
(iv) There will be no limit to the number of chances allowed to an MTS (Group-C) official or GDS for appearing the Postman/Mail Guard Examination provided he/ she is within the prescribed age limit (Directorate letter No. 44-31/87-SPB-I dated 28.8.90).
(v) The heads of the Unit/ Division will call for the applications in the prescribed proforma (enclosed vide Annexure-I), scrutinize those applications as per Department of Posts Postman/Mail Guard Recruitment Rules, 2010 & Department of Posts Postman/Mail Guard Rectt(amendment) Rules, 2012 and then issue Admit Cards to the eligible candidates by the scheduled date(18-10-2017). A specimen copy of the proforma for issue of Admit Cards  is enclosed in Annexure-II. The candidates should also be instructed to submit two copies of recent passport size photographs duly attested along with their applications duly filled in the prescribed proforma.                                       
(vi) One copy of the photograph will be pasted on the application form at the space provided for the purpose and another photograph to be used at the time of issue of Admit Card.
7   .  A list of candidates separately for Departmental candidate and GDS should be prepared in the prescribed proforma enclosed as Annexure-III and the same should be submitted to this office by the scheduled date(13.10.2017). The name of the Departmental candidates as well as GDS should be furnished in separate proforma report in order of their seniority in their respective post/ cadre. At the end of the list in the proforma report  a summary should be drawn as follows :
 (i)Total no. of  Departmental candidates  - (MTS) applied for examination.
(a)Total no. of Departmental candidates permitted to appear the Examination.
(b)Total no. of Departmental candidates not permitted to appear the Examination.
(ii)    Total no. of  GDS applied for the examination.
(a)Total no. of GDS permitted to appear the examination.
(b)Total no. of GDS not permitted to appear the        examination.
8.The Examination will be conducted at the HQ  of three Regions in the Circle. The Officer nominated by CO/RO will conduct the examination as per schedule.
     9.The pattern and syllabus for examination
    The pattern and syllabus for examination to fill up the posts of Postman & Mail Guard by promotion on the basis of Limited Departmental Competitive Examination by promotion from amongst MTS & Direct Recruit from amongst GDS will be as per revised syllabi and pattern issued vide Directorate letter NO.45-14/2012-SPB-I dated 17.01.2014 circulated vide CO letter No.RE/30-13/75(Rlg)/Corr/Ch-III dated 24.02.2014 and as follows.  The qualifying marks will be as mentioned in the annexure to the Directorate letter No. 45-14(ii)/2012-SPB-I dated 31.07.2012 circulated vide CO letter No. RE/30-13/75(Rlg)/Corr dated 18.09.2012.
