OFFICE MEMORANDUM

Subject: Grant of Dearness Relief to Central Government pensioners/family pensioners - Revised rate effective from 1.7.2016 on implementation of decision taken on recommendation of 7th Central Pay Commission.
The undersigned is directed to say that subsequent to implementation of the decision taken by the Government on the recommendation of the 7th Central Pay Commission, the President is pleased to decide that the Dearness Relief admissible to Central Government pensioners/family pensioners shall be as follows:

Note:- Dearness Relief at the rates indicated in the above table will also be admissible on the additional basic pension/additional family pension available to older pensioners/family pensioners based on their age as indicated in this Department’s OMs 38/37/2016-P&PW(A)(i) dated 04.08.2016 and 38/37/20 16-P&PW(A)(ii) dated 04.08.2016.

2. These orders apply to (i) Civilian Central Government Pensioners/Family Pensioners (ii) The Armed Forces Pensioners, Civilian Pensioners paid out of the Defence Service Estimates, (iii) All India Service Pensioners (iv) Railway Pensioners/family pensioners.

3. These orders will not be applicable on following categories:-

(i) The Burma Civilian pensioners/family pensioners and pensioners/families of displaced Government Pensioners from Pakistan, who are Indian Nationals but receiving pension on behalf of Government of Pakistan and are in receipt of adhoc ex-gratia allowance.

(ii) Central Government Employees who had drawn lump sum amount on absorption in a PSU/Autonomous body and are in receipt of 1/3rd restored commuted portion of pension.

(iii) Pensioners who are in receipt of provisional pension in the pre-20 16 pay scales/pay.

(iv) CPF beneficiaries, their widows and eligible children who are in receipt of ex-gratia payment in terms of this Department’s OM No. 45/52/97-P&PW(E) dated 16.12.1997 and revised vide this Department’s OM 1/10/2012-P&PW(E) dated 27.06.2013.

Separate orders will be issued in respect of the above categories.

4. Payment of DR involving a fraction of a rupee shall be rounded off to the next higher rupee.

5. Other provisions governing grant of DR in respect of employed family pensioners and re-employed Central Government Pensioners will be regulated in accordance with the provisions contained in this Department’s OM No. 45/73/97-P&PW (G) dated 2.7.1999 as amended vide this Department’s OM No. F.No. 38/88/2008-P&PW(G) dated 9th July, 2009. The provisions relating to regulation of DR where a pensioner is in receipt of more than one pension will remain unchanged.

6. In the case of retired Judges of the Supreme Court and High Courts, necessary orders will be issued by the Department of Justice separately.

7. It will be the responsibility of the pension disbursing authorities, including the nationalized banks, etc. to calculate the quantum of DR payable in each individual case.

8. The offices of Accountant General and authorised Pension Disbursing Banks are requested to arrange payment of relief to pensioners etc. on the basis of these instructions without waiting for any further instructions from the Comptroller and Auditor General of India and the Reserve Bank of India in view of letter No. 528-TA, 1I/34-80-U dated 23/0411981 of the Comptroller and Auditor General of India addressed to all Accountant Generals and Reserve Bank of India Circular No. GANB No. 2958/GA-64 (ii) (CGL)/81 dated the 21st May, 1981 addressed to State Bank of India and its subsidiaries and all Nationalised Banks.

9. In their application to the pensioners/family pensioners belonging to Indian Audit and Accounts Department, these orders issue after consultation with the C&AG.

10. This issues in pursuance of instructions of Ministry of Finance, Department of Expenditure vide their OM No. 112/2016-E.II(B) dated 4th Nov, 2016.

Banks, Post offices to report cash deposits of over Rs 2.5 lakh to I-T


The government has asked banks and post offices to report to the I-T Department all deposits above Rs 2.50 lakh in savings accounts, and more than Rs 12.50 lakh in current accounts, made during the 50-day window provided to tender the scrapped 500 and 1000 rupee notes. 

As per a notification issued today, banks, co-operative banks and post offices will have to report to the tax department cash deposits exceeding Rs 50,000 in a single day or aggregating to more than Rs 2.5 lakh during the period November 9, to December 30, 2016. 

These entities will also have to report cash deposits during the period aggregating to Rs 12.50 lakh or more, in one or more current account of a person. 

The Finance Ministry has notified the amended Rule for filing of Annual Information Return (AIR) report by banking company, cooperative bank and post offices on account of aggregate cash deposits in one or more current account of a person. 

Banks and post offices now have to file a statement of financial transaction in respect of these transactions on or before January 31, 2017, the notification said. 

Earlier, they were required to report to the I-T Department only when cash deposits in an account exceeded Rs 10 lakh in one full year. 
In view of apprehensions that large number of illegal or black money may sought to be converted into white during the window provided till December 30, the Revenue Department has issued fresh set of instructions. 

In a major assault on black money, counterfeit notes and terror financing, Prime Minister Narendra Modi had on November 8 announced demonetisation of high value currency notes of Rs 1000/500 and asked the public to deposit them in banks by December 30. 

Since then, seemingly unending queues of people trying to deposit and exchange their scrapped currency notes are being witnesses at banks and post offices. 

Tax department officers are of the view that the 50-day window provided to people to deposit or exchange notes should not be misused and hence the need to keep a tab on such high value deposits. 

Those depositing large amounts of unaccounted money will have to face the consequences under tax laws, which provide for a 30 per cent tax, 12 per cent interest and a 200 per cent penalty. 

"CBDT has brought two-fold amendment casting a reporting responsibility on the taxpayer as well as the bank, thereby ensuring that bank doesn't let go off the non-compliant taxpayers," Nangia & Co Managing Partner Rakesh Nangia said.

The government has announced a new rule to prevent people from making multiple cash deposits in their bank accounts without quoting the PAN. Till now, the limit for cash deposit without PAN was Rs 50,000 per transaction. A lot of people were depositing less than Rs 50,000 per day to escape the PAN provision. But a circular issued on Tuesday says deposits made between 9 Nov and 30 Dec 2016 will require a PAN if the combined sum exceeds Rs 2.5 lakh. This clarifies the misconception that one can deposit cash in multiple batches of less than Rs 50,000 each and escape mentioning the PAN. 


The CBDT has also made changes in the (AIR) Annual Information Return rules. Till now, banks and post office branches were supposed to report to the tax department if an individual made cash deposits of Rs 10 lakh in a year. During the period 9 November to 30 December, this limit has been lowered to Rs 2.5 lakh.If the cash deposits exceed this limit, the bank or post office will automatically report it to the tax department. For current accounts, the threshold limit for cash deposits between 9 November and 30 December will be Rs 12.5 lakh. 


The rule applies to all bank accounts of the individual, though it is not clear how banks will be able to capture information of cash deposited in other bank accounts.

OFFICE MEMORANDUM

Subject: Remittance into Government Account of cash by offices of Government of India as specified in SO No. 3407(E) dated 8th November, 2016 notified in Extraordinary Gazette and subsequent S.Os.


A reference is invited to this Office OM No. 3(2)2016/TA/585 dated 10th November. 2016 on the subject cited above (copy enclosed). Government has since issued further Notifications vide SO No 3408 (E) dated 8th November 2016, SO No. 3429(5) dated 10th November, 2016 and so No. 3443 (E) dated 14‘“ November, 2016 enlarging the scope of payments through Specified Bank Notes of Government dues towards fees, utilities charges, etc. payable to the concerned authorities of the Central/State Governments/Local Bodies. The Notification also extends the permissible date for deposit of all such Government dues from 14th November, 2016 to 24th November, 2016.

2. It is, therefore reiterated that all such receipts should be deposited into Government Account through the accredited bank, as stipulated in Rule 6 of CGA (Receipt & Payments) Rules 1983.

    Demonetisation : Financial Advise for Deposit amount in your account

    Financial Advise :


    1. Deposit cash less than Rs. 50000 at one time & 10 lac cash in a year (1.4.16 to 31.3.17) in saving bank account. To avoid Income tax department Notice.

    2.Do not deposit cash more than Rs.2 lakh in saving bank account (from 11/11/16 to 31/12/16). If you are non tax payer. To avoid Income tax department Notice.

    3. Don't try to be over smart
    By depositing cash in your different different saving bank accounts. As for income tax limits (Rs. 200000 & Rs.1000000) those will be considered all together.

    4. Till 30th December no limit for depositing cash in bank so people may do a mistake.

    5. Pan card must for depositing Rs.50000 /- and more.

    6. Don't use Credit Card for shopping more than Rs. 200000 (from 01/04/2016 to 31/03/2017). To avoid Income tax department Notice.

    7. Do not panic and rush to the banks or post office for depositing the old notes.You are monitored.

    8. Understand the impact. When you go to the bank for depositing the same you first check that whether you have cash balance in your books or not.

    9. Any unexplained cash deposit attract tax @30%, interest & 200% penalty.

    10. Update your books of accounts immediately to know cash position.
