Sub:- Fixation of pay and grant of increment in the revised Pay structure — clarifications – regarding.
Following the notification of Railway Services (Revised Pay) Rules, 2016, Railway Board has received references seeking clarifications regarding various aspects of fixation of pay in the revised pay structure as also pay fixation and grant of increment in future under revised pay structure. These matters have been considered by Ministry of Finance and the points of doubts are clarified as under:-
Point of doubt
As per the provisions of FR 22 (l)(a)(1), the Government Servants (other than those appointed on deputation to ex- cadre post or ad-hoc basis or on direct recruitment basis) have the option, to be exercised within one month from the date of promotion, to have the pay fixed under this rule from the date of such promotion/appointment or from the date of next increment.
Some of the employees, promoted between 01.01.2016 and the date of notification of RS(RP) Rules, 2016 had opted for their pay fixation on promotion/financial up-gradation under MACPS from the date of their next increment in the lower grade. Consequent upon notification of RS(RP) Rules, 2016 i.e. 28th July, 2016, the option submitted by such employees has now turned out to be disadvantageous.
Whether such employee may be allowed to revise their option under FR 22(I)(a)(1) at this stage.
Under the changed circumstances after notification of RS(RP) Rules, 2016, the employee may be allowed to exercise revised option for fixation of pay under FR 22(I)(a)(1). Such revised option shall be exercised’ within one month of issue of this letter. Option so revised shall be final.
Whether employees appointed/promoted/granted financial upgradation during 02.01.2015 and 01.07.2015 will be entitled to grant of one increment on 01.01.2016
Since, the provisions of RS(RP) Rules, 2016 are effective from 01.01.2016, no increment shall be allowed on 01.01.2016 at the time of fixation of pay in the revised pay structure.
Smt. Maneka Sanjay Gandhi expresses concern at the inadequate implementation of Sexual Harassment of Women at Workplace (Prevention, Prohibition and Redressal) Act, 2013
WCD Ministry to set up Inter-Ministerial Committee and an e-platform for effective redressal of complaints of sexual harassment at workplace
The Minister of Women and Child Development, Smt. Maneka Sanjay Gandhi held a review meeting on implementation of the Sexual Harassment of Women at Workplace (Prevention, Prohibition and Redressal) Act, 2013 in New Delhi today. Officials from the WCD Ministry, DoPT, Ministry of Youth Affairs & Sports, Ministry of Home Affairs, Ministry of Railways and Department of Financial Services were present. Smt. Maneka Sanjay Gandhi expressed her concern that the complaints of sexual harassment are not being handled in a timely as well as sensitive manner. She also expressed her concern that harassment often continues over a period of time and it is only after it becomes unbearable that a woman comes out to complain. In such situations, it is the duty of Internal Complaints Committee to decide on the complaint in the shortest possible time. The Minister also pointed out that the transfer of the aggressor can never be a solution to such a complaint and there should be harsher punishments when the complaint is found to be true.
2. After extensive deliberations, the following decisions were taken:
(i) The Ministry of WCD will set up an inter-ministerial committee headed by a senior official of the WCD Ministry. This committee will review the progress of disposal of complaints of sexual harassment, get a standardized training module prepared in collaboration with ISTM, ensure that heads of Internal Complaints Committee of all ministries/departments are given training on how to handle the complaints.
(ii) The ministry will be establishing a secure electronic platform for any woman employee of the government to file a complaint under the Act directly to the Ministry of WCD. These complaints will be then taken up with the respective ministries/ departments. This will enable a monitorable and transparent system of grievance redressal under the Act.
(iii) All ministries/ departments will furnish a monthly report to WCD ministry on the number of complaints received, disposed, pending and action taken etc.
(iv) All ministries/ departments and attached offices will furnish the annual statistics of complaints received and disposed under the Act in their Annual Reports. It was also decided that the inter ministerial committee will create a panel of resource persons from which ICCs can take the external members. In another important decision taken at the meeting today, all the training programmes of all services will have a module on the Act and DoPT will issue necessary instructions for this.
(v) It was also decided that the respective cadre controlling authority will keep every complainant under observation for a period of five years so that she is not subjected to any further administrative harassment as a result of her having complained against a male superior.
(vi) It was agreed that the Act, the rights of a woman official and the responsibility of the ICC must be given adequate publicity through different methods including the websites of the ministries/ departments/ attached offices.
New Delhi, Oct 26 (PTI) In what could bring cheers to 50 lakh central employees and 58 lakh pensioners ahead of Diwali, the Centre is all set to announce 2 per cent dearness allowance to be effective from July 1, 2016.
"The proposal to provide 2 per cent dearness allowance and dearness relief to central government employees and pensioners respectively, is listed on agenda of the Union Cabinet meeting scheduled for tomorrow," a source said.
Dearness allowance and dearness relief is provided to employees and pensioners to neutralise the impact of price rise on their earnings.
Earlier this year the government hiked Dearness Allowance by 6 per cent to 125 per cent of the basic pay. The DA was later merged into the basic pay following implementation of 7th Pay Commission award.
The central government employee unions want that the DA should be increased by 3 per cent and not 2 per cent which is being considered by the centre.
President of Confederation of Central Government Employees K K N Kutty told PTI: "The 12-month average of Consumer Price Index for Industrial Workers from July 1, 2015 to June 30, 2016, works out to be 2.92 per cent. Therefore the unions had pressed for 3 per cent DA. We are not satisfied with this."
As per the agreed formula, government increases DA on the basis of 12-month average of the retail inflation and does not consider the price rise rate beyond decimal point for deciding the rate of dearness allowance.
